GOTB MEMBERSHIP TERMS AND CONDITIONS

By enrolling in or accessing any On The Ball, LLC (“On The Ball,” “we,” “us,” or “our”) membership, program, platform, content, or service (collectively, the “Services”), you (“Member,” “Subscriber,” or “you”) agree to be bound by these Terms & Conditions (“Agreement”).


If you do not agree to these Terms, do not purchase or use the Services.


1. Membership Plans & Payment Terms

1.1 Membership Options

    •    Annual Membership: Billed upfront for a 12-month term at the then-current rate.

    •    Monthly Membership: Billed monthly with a minimum 3-month commitment.

    •    Enterprise Membership: Custom plans governed by separate written agreements.

1.2 Payment Authorization

By subscribing, you authorize On The Ball to charge the payment method you provide on a recurring basis in accordance with your selected plan.

Payments are processed through Stripe or its authorized payment processors.

Membership fees are non-transferable.


2. Access & Use of Services

Membership provides access to digital training content, live or recorded coaching sessions, tools, resources, and community features as described on the website.

We may update, modify, replace, or discontinue any aspect of the Services at any time.

We do not guarantee uninterrupted or error-free access.


3. Cancellation Policy

3.1 Monthly Memberships

Monthly memberships require a minimum 3-month commitment.

Early cancellation does not waive the obligation to complete the initial 3-month payment term.

After the initial 3-month term, you may cancel at any time to prevent future charges.

3.2 Annual Memberships

Annual memberships are billed upfront for a 12-month term.

You may cancel at any time to prevent automatic renewal. Cancellation does not result in refunds or prorated credits. Access remains active through the end of the paid term.


4. Refund Policy

4.1 30-Day Money-Back Guarantee

All new memberships include a one-time 30-day money-back guarantee beginning on the date of initial enrollment, provided that you have not accessed, streamed, viewed, or downloaded any membership content.

Once content has been accessed, all payments become final and non-refundable, even within the 30-day period.

Refunds apply only to the initial enrollment payment and do not apply to renewals, upgrades, add-ons, or subsequent charges.

4.2 No Refunds After Access or After 30 Days

Except as expressly stated above, all payments are final and non-refundable once content has been accessed or after 30 days — whichever occurs first.

No partial refunds, prorated refunds, or credits will be issued for unused time, partial usage, early cancellation, or dissatisfaction.

4.3 Billing Errors

If you believe a charge was made in error, duplicated, or caused by a technical or processing mistake, you must contact us within 7 days of the charge for review.

Approved billing errors may be corrected at our discretion.


5. Account Use & Sharing

Membership access is granted to a single individual unless a team or enterprise plan is purchased.

Sharing login credentials, redistributing content, recording, reproducing, or enabling third-party access is prohibited and may result in termination without refund.


6. Abuse, Misuse & Circumvention

We reserve the right to suspend or terminate access without refund for:

    •    Abuse of the refund or dispute process

    •    Attempts to extract, scrape, copy, or replicate content

    •    Use of automation, bots, or circumvention tools

    •    Violation of these Terms or acceptable use standards


7. Payment Disputes & Chargebacks

You agree to contact us before initiating any chargeback or payment dispute.

Unauthorized chargebacks may result in suspension or termination of access and may be pursued for recovery of unpaid amounts.

We reserve the right to submit these Terms, access logs, and transaction records to payment processors and dispute bodies.


8. Pricing, Discounts & Promotions

Discounted or promotional pricing applies only to the stated term unless otherwise specified in writing.

Renewals may be billed at the then-current standard rate.

No refunds or price adjustments will be issued due to later promotions, discounts, or pricing changes.


9. Enterprise & Custom Agreements

Enterprise memberships and custom agreements may be governed by separate written contracts. Where conflicts exist, the signed enterprise agreement controls.


10. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, outages, government actions, pandemics, or labor disputes.


11. Governing Law & Venue

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

Any dispute shall be resolved exclusively in the state or federal courts located in Florida.


12. Severability

If any provision of this Agreement is found invalid or unenforceable, the remaining provisions remain in full force.


13. No Waiver

Failure to enforce any right or provision does not constitute a waiver.


14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms.
